General Terms and Conditions

 

Welcome,

 

Visit Malta Today provides the Users and Suppliers of tours or tourist services with this Booking Platform.

We help Users to research and book travel experiences in Malta. We do not provide such experiences ourselves. When you make a booking, you will be purchasing a tour, ticket or service directly from the Supplier.

Our Suppliers are all licensed and with long-time experience.

Contracts for tourist services are to be concluded directly between the Users of this Booking Platform and the Suppliers of tours or tourist services.

Visit Malta Today is not a contracting party in regard to the tours or the tourist services offered on it. Visit Malta Today does not appear itself as the organizer, lessor, or another contract partner in regard to the tourist service agreement with the User.

These Terms and Conditions of use, together with our Privacy Policy, apply to any use of the Booking Platform. Visitors and Users of the Visit Malta Today Booking Platform may use it only on condition that they accept the Terms and Conditions of use and read and understand the Privacy Policy.

Visit Malta Today may update these Terms and Conditions of use at any time, without stating the reasons, and you understand and agree that continue accessing or using this Booking Platform after such change signifies your acceptance of the updated Terms and Conditions.

By visiting and using this Booking Platform, you agree to be bound by these Terms and Conditions and Privacy Policy and you agree that you have read and understood them.

Definitions

‘Booking Platform’ means the website provided by Visit Malta Today, allowing users to reserve tours or tourist services provided by the Suppliers.

‘Tour’ means the excursion(s) or series of excursions that are the subject of a Booking and/or Confirmation.

‘Services’ means a system supplying any touristic needs such as transport, tours, activities, vehicles rent, water sports, guided trips, private tours, diving courses, entrance tickets, or other experiences arranged from the Suppliers.

‘Supplier’ means travel or tour agency or company, who provide the tours or the services.

‘User’ or ‘Client’  means an individual, firm, agency, or company who makes the Booking with the Supplier through this Booking Platform.

‘Booking’ means the order placed by the User in response to a Quotation. (reservation)

‘Confirmation’ means acceptance by the Supplier.

‘Function’ means the function(s) or series of functions that are the subject of a Booking and/or Confirmation.

Use of the Services 

As a condition of your use of this Booking Platform, you represent and warrant that all information supplied by you in the course of your use is true, accurate, current, and complete.

Your use of the Services is permitted by Visit Malta Today only for personal, non-commercial use and/or to make legitimate requests to make a Booking of the Tours or the touristic services offered. You agree not to use this Booking Platform to make any speculative, false, or fraudulent requests or bookings.

Visit Malta Today reserves the right at sole discretion to decline access to its Services to anyone, at any time and for any reason, including but not limited to, for violation of these Terms and Conditions.

Bookings  and/or Enquiries

When you make a booking, you agree to review and be bound by the applicable Suppliers Terms and Conditions and any other rules or policies related to the Tour or the Service. Kindly read the Suppliers Terms and Conditions below.

Your interactions with Suppliers are at your own risk. We will have no liability with respect to the acts, omissions, errors, representations, warranties, breaches, or negligence of any Supplier or for any personal injuries, death, property damage, or other damages or expenses resulting from your interactions with any Supplier.

Notwithstanding the foregoing, to the extent that the Supplier Terms conflict with these Terms of Use in respect of your legal relationship with Visit Malta Today, these Terms and Conditions of Use shall prevail.

Pricing and Payments

All prices are per person in Euro €, unless otherwise specified as a package or day price and inclusive of Value Added Tax.

The Supplier might have otherwise specified, prices do not include some fees.

Prices are subject to change without notice until a booking has been made.

Prices do not include tips/gratuities.

Visit Malta Today is permitted to collect the invoiced (full or partial) amounts in the name of and on behalf of the Supplier.

Visit Malta Today reserves the right to make the use of the payment function dependent on a check of the credit rating of the User.

The invoiced refund amount (fully or partially collected from Visit Malta Today)  granted by the Supplier can also be processed by the Supplier via this Booking Platform.  

When you make a booking, Visit Malta Today collects your payment information and processes your payment. Full or partial payment by credit or debit card is required to make a booking, unless otherwise specified.

The value of your booking may be subject to taxes, duties, foreign transactions, currency exchange, or other fees. Your bank or payment card company may convert the payment into the local currency and may charge fees, resulting in differences between the amount displayed through this Booking Platform, and the final amount charged to you.

We recommend that you contact your bank or card company if you have any questions concerning any applicable currency conversion or fees.

The User has to enter correct payment information and update the details immediately if any changes are applied. During the booking process, the User will be notified of the payment methods permitted for the respective service.

Upon the authorization of the payment, the User consents to his/her payment information being used for the collection of payments by the creditor.

The price of the services does not include insurance in case it is not specified by the Supplier. You are responsible for providing sufficient insurance protection. The requirement for insurance depends on the activity booked.

Cancellations and Refunds

When a Tour has been purchased, your Booking can not be changed by you or cancelled with a refund, unless otherwise stated in the terms and conditions applicable to such Tour.

Occasionally a Supplier may make a change to a Tour after your purchase, including but not limited to the date, price, inclusions, coverage, age requirements, and/or any other Tour features and/or requirements. As a result, Visit Malta Today reserves the right to cancel, change or substitute any Tour that you have purchased, at any time, for any reason. If the change proposed by the Supplier is, for example, a change in dates and/or a significant change to the itinerary, and you are dissatisfied with the alternative that is offered, you will be entitled to a full refund of the original purchase price.

The Supplier can cancel the activity on the agreed date without observing a period of notice, if weather conditions, official measures, strikes, or other unforeseeable or unavoidable external conditions (in particular force majeure) make the activity impossible, make it considerably more difficult, or endanger it. In this case, the paid price is refunded.

Cancellations due to health problems or conditions and missing personal documents – licences, identification documents, or age less than the Supplier required will not be refunded.

Kindly note that any refunds through Visit Malta Today Booking Platform should be confirmed by the Supplier before being processed.

 

Availability and Warranty

Visit Malta Today Booking Platform makes no guarantee or warranty for the accuracy or completeness of data provided by Suppliers or the services provided by the Suppliers.

There is no claim for availability, quality or service features, or technical support for the Visit Malta Today Booking Platform. We can redesign, reduce or suspend our Platform at any time. The existing agreements of the User with a Supplier, as well as the execution of these agreements, will remain unaffected by these changes.

The contact partner of the User in the event of questions and claims in connection with a service agreement and its execution is the respective Supplier.

Data protection

Visit Malta Today collects and uses data of users to the extent that is necessary for the creation, design of content, or modification of the contractual conditions.

If Visit Malta Today is involved in the communication for a service agreement between the User and the respective Supplier, it shall transfer the data required for this agreement to the respective Supplier. This Supplier processes and uses the data to initiate, conclude and execute the contract on its own responsibility.

Visit Malta Today -Liability

Visit Malta Today provides the Users and Suppliers of tours or tourist services with this Booking Platform.

If Visit Malta Today has not assumed a corresponding contractual obligation by means of an explicit agreement with the User, it is not liable for the realization of corresponding agreements with Suppliers in line with the booking request of the User.

Without an explicit agreement or an assurance of this kind, Visit Malta Today is not liable for defects in the performance of the service and personal or material damage incurred by the User in connection with the travel service provided, concerning the services provided. 

Any liability of Visit Malta Today due to the culpable violation of obligations in the brokering of contracts remains unaffected by the aforementioned conditions.

Visit Malta Today Booking Platform is not liable for any personal injury, death, property damages, or other damages and expenses connected with any booking or use of it.

Visit Malta Today shall bear no liability for loss damage delay or failure of performance however arising caused in circumstances outside its control including (but not limited to) Acts of God, civil commotion, strike, work to rule or go slow, lock-outs, hostilities, fire, flood, drought or inability to procure materials, venues or services except at increased prices due to any of the foregoing causes (and in these circumstances Visit Malta Today may suspend or cancel the whole tour). Visit Malta Today will endeavour to notify the User as quickly as reasonably possible if a Force Majeure event occurs. In the event of Force Majeure occurring, and a cancellation is made, refunds will be dealt with in accordance with clause Cancellations and Refunds section of these Terms and Conditions of the Supplier.

The Suppliers are independent contractors, not our agents or employees. Execution of their services is at their sole responsibility. Visit Malta Today Booking Platform is not liable for any Suppliers errors, omissions, acts or breaches, representations, or warranties.

Users Liability

Any User who made a Booking is responsible for arriving on time at the notified meeting point.

Any User is also responsible to provide correct booking details.

Any User who made a Booking is responsible to keep and present Visit Malta Today reservation email to the Supplier. In rare cases, the payment email may also be required.

If you are travelling to an activity to/from abroad, you are responsible for having the necessary travel documents (passport, etc.), and for observing the health regulations regarding Covid-19.

Suppliers Liability and Terms & Conditions

If Supplier includes in addition to these Terms and Conditions of Supplier of tours and other tourist services of further participation or transport or other terms in a contract with you, you are responsible for observing these additional terms. The Supplier reserves the right to exclude participants from the activity if they do not meet these conditions.

The Supplier reserves the right to accept clear instructions in writing from a Client to proceed with a Booking and to enter into commitments on behalf of a Client regardless of whether a deposit or full payment has been received. The Client shall thereon be liable for all costs and expenses incurred by the Supplier in pursuance of the Client’s instructions, and shall in all other respects be liable to the Supplier for its fees charges and commissions.

A Confirmation means that (at the Supplier’s discretion, subject to relevant payments being received) the Company will proceed to arrange the tour and book facilities. It does not mean that the facilities are confirmed to be available and booked. All Confirmations are subject to availability.

All Bookings of whatever nature are accepted on the understanding that the number of persons for whom the tour is arranged is regarded as the minimum and no refund or allowance shall be made by the Supplier if fewer persons actually attend the tour.

 

CANCELLATION

Should the Client cancel the Booking, it may do so by giving written notice. In such circumstances, the following conditions shall apply:

Cancellation is on the express condition that the Client shall indemnify the Supplier against all loss, costs, damages, claims, or actions arising out of such cancellation;

Deposits shall be retained by the Supplier and used so far as possible to offset costs incurred including, without limitation, the loss of profit to the Supplier due to the cancellation;

Unless written notice of the cancellation is received by the Supplier at least 30 days prior to the Tour, the unpaid outstanding balance of the total price quoted, or the event shall become immediately payable by the Client;

All costs and expenses incurred by the Supplier up to the time of written cancellation shall be payable by the Client to the Supplier;

The Supplier may cancel a Confirmation at any time, upon notice to the Client if:

The Client is in breach of the Terms and Conditions including, without limitation, any term relating to payment; or

Cancellation is reasonably necessary due to the occurrence of a Force Majeure event.

 

LOSS AND DAMAGE

Any loss or damage to equipment or property will be the responsibility of the Client, and all replacement and repair costs will be charged in full.

The Supplier does not accept any responsibility for the loss or damage to personal property belonging to Clients or their guests.

 

LIABILITY

Neither the Supplier nor its employees shall be liable for any injury, damage, loss, illness, delay, or expense caused to the Client, its employees, licensees or invitees or any other person or any other persons attending the booked Event except insofar as such injury, loss, illness, delay or expense results from the proven negligence or deliberate action or omission of the Supplier. The Supplier’s liability shall in all cases be limited to the sums paid by the Client and excludes all indirect or consequential loss of whatever nature. Nothing in this clause shall affect the Supplier’s liability for death or personal injury caused by its negligence, for which the Supplier maintains insurance of up to xxx per claim or series of related claims.

Sub-Contractors may be engaged on behalf of the Client. The liability of the Supplier in their failure to perform is limited to the value of the sub-contractors services.

 

FORCE MAJEURE

The Supplier shall bear no liability for loss damage delay or failure of performance however arising caused in circumstances outside its control including (but not limited to) Acts of God, civil commotion, strike, work to rule or go slow, lock-outs, hostilities, fire, flood, drought or inability to procure materials, venues or services except at increased prices due to any of the foregoing causes (and in these circumstances, the Supplier may suspend or cancel the whole or any part of the Tour). The Supplier will endeavour to notify the Client as quickly as reasonably possible if a Force Majeure event occurs. In the event of Force Majeure occurring and a cancellation being made, refunds will be dealt with in accordance with clause 5.

 

SPECIAL CONDITIONS

The Supplier reserves the right to add further special conditions for specific bookings, as and where considered appropriate, and any such conditions will be notified to the Client in writing prior to Confirmation.

For identification purposes, please wear your sticker prominently during the guided tours.

When entering churches, you are requested to cover your arms and not to wear shorts or skirts that are too short. Stiletto or narrow heels are prohibited in St. John’s Co-Cathedral.

We may at our discretion, require any person to withdraw from any tour if we deem their acts or conduct offensive or a nuisance to other clients, and we shall have no further liability.

We reserve the right to alter, change the routing of, or otherwise amend any part of the proposed tour. We shall not incur any liability towards you where such as strikes, weather conditions, riots, etc occur.  Notwithstanding anything contained in law, any liability we may have for any claim whatsoever is limited to a refund of the price of the excursion ticket.

We also reserve the right in our entire discretion to cancel a  tour, in which event you shall be refunded the price of your ticket.

You are reminded not to forget any of your personal belongings anywhere and, in particular, in the transport provided. In spite of staff’s efforts, no guarantees can be made for recovery.

 

WARRANTY AND LIMITATION

The Supplier warrants that the services supplied by it will be provided with reasonable skill and care. The Supplier’s liability under this warranty shall be limited as specified above.

Our Booking System

You will receive a Visit Malta Today branded email (or, alternatively, a voucher from the Supplier) (in each case, a “Ticket”) for each Service you book. You will receive your Ticket by the email provided when creating the booking. You will also receive a payment confirmation email. It is the sole responsibility of the User to provide a valid email. In case the provided email is wrong, kindly contact Visit Malta Today to find an alternative solution.

You must provide the original, authentic Ticket to the applicable Supplier in order to redeem your service. Your Booking cannot be honoured or redeemed without presenting a valid Ticket. Ensure you read the Terms and Conditions relating to your Booking in order to understand what will be required by the Supplier by way of Ticket presentation.

In rare cases, a Supplier may also require that you present the payment email for purchasing your Service at the time of redemption.

Website Prohibited Activities

The content and information on the Website (including, but not limited to, messages, data, information, text, music, sound, photos, graphics, video, maps, icons, software, code, or other material, and collectively described herein as the “Website Content”), as well as the infrastructure used to provide such Website Content, is proprietary to us. You agree not to otherwise modify, copy, distribute, transmit, display, perform, reproduce, publish, licence, create derivative works from, transfer, or sell or re-sell any Website Content, or any products or services obtained from or through the Website. Any other use of the Website Content, products and/or services requires the prior written permission of Visit Malta Today.

 

Additionally, you agree that you will not and will not assist or enable others to:

  1. use the Website or the Website Content for any commercial or unlawful purpose;
  2. access, monitor or copy any Website Content using any robot; spider, scraper, or other automated means or any manual process to access, scrape, index, retrieve, or otherwise use the Website or any Website Content for any purpose without our express written permission;
  3. violate the restrictions in any robot exclusion headers on the Website or bypass or circumvent other measures employed to prevent or limit access to the Website;
  4. take any action that imposes, or may impose, in our discretion, an unreasonable or disproportionately large load on our infrastructure or makes excessive traffic demands on the Website;
  5. deep-link to any portion of the Website for any purpose without our express written permission;
  6. “frame”, “mirror” or otherwise incorporate any part of the Website into any other website without our prior written authorization;
  7. attempt to modify, translate, adapt, edit, decompile, disassemble, or reverse engineer any Software;
  8. use the Website to threaten, stalk, defraud, incite, harass, or advocate the harassment of another person, or otherwise interfere with another user’s use of the Website;
  9. use the Website to submit or transmit spam, chain letters, contests, junk email, pyramid schemes, surveys, or other mass messaging, whether commercial in nature or not;
  10. use the Website in a manner that may create a conflict of interest, such as trading reviews with other business owners or writing or soliciting reviews;
  11. use the Website to promote bigotry or discrimination against protected classes;
  12. use the Website to violate any third-party right, including any breach of confidence, copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right;
  13. use the Website to submit or transmit pornography or illegal content;
  14. use the Website to solicit personal information from minors, or to harm or threaten to cause harm to, any person, including minors;
  15. attempt to gain unauthorized access to the Website, user accounts, computer systems, or networks connected to the Website through hacking, password mining, or any other means;
  16. use the Website to transmit any computer viruses, worms, defects, Trojan horses, or other items of a destructive nature (collectively, “Viruses”);
  17. use any device, software, or routine that interferes with the proper working of the Website, or otherwise attempt to interfere with the proper working of the Website;
  18. use the Website to violate the security of any computer network, crack passwords or security encryption codes;
  19. disrupt or interfere with the security of, or otherwise cause harm to, the Website; or
  20. remove, circumvent, disable, damage, or otherwise interfere with any security-related features of the Website, features that prevent or restrict the use or copying of Website Content, or features that enforce limitations on the use of the Website.
